These Terms of Service (“Terms”) govern your access to and use of the Condo1 Property Management Inc. (“Condo1,” “we,” “us,” or “our”) website at condo1.ca and any related digital services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who We Are

Condo1 Property Management Inc. is a property management company based in Toronto, Ontario, Canada. We provide rental property management, tenant placement, maintenance coordination, rent collection, and related services to residential property owners across the Greater Toronto Area. These Terms apply to the Services provided through this website. A separate written property management agreement governs the professional management services we provide to clients.

2. Use of the Services

You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Services. In particular, you will not:

• Use the Services to send unlawful, harassing, defamatory, abusive, threatening, or otherwise objectionable content.
• Attempt to gain unauthorized access to any portion of the Services, our systems, or our data.
• Scrape, copy, or systematically extract content from the Services for commercial purposes without our written permission.
• Submit false, misleading, or impersonating information through any form on the Services.
• Interfere with or disrupt the integrity, security, or performance of the Services.

3. Submissions and Account Information

Information you submit through any form on the Services (contact, property onboarding, tenant application, maintenance request) is handled in accordance with our Privacy Policy. You represent and warrant that any information you submit is accurate, complete, and that you have the right to submit it. We may contact you about your submission by email, phone, or SMS (where you have consented) in response to your inquiry.

4. SMS Program Terms

SMS Program Description

The Condo1 Property Management Inc. SMS messaging program sends transactional customer service messages only. If you opt in, you will receive the following types of SMS messages from Condo1 Property Management Inc.:

(a) Maintenance request confirmations, scheduling, and status updates for the property you have registered with us as a tenant;

(b) Appointment confirmations and reminders for property viewings, inspections, and move-in/move-out walkthroughs;

(c) One-to-one replies from our property managers confirming receipt of your inquiry and following up on your active engagement with us (property management proposals, lease questions, service updates).

The Condo1 Property Management Inc. SMS program does not send promotional messages, marketing broadcasts, alerts, notifications about products or services you have not inquired about, or automated campaign messages of any kind.

Message and Data Rates

Message and data rates may apply based on your wireless carrier's plan for any SMS messages you send to or receive from Condo1 Property Management Inc. Message frequency varies depending on your inquiry, lease status, or property management engagement. Condo1 Property Management Inc. is not responsible for any charges imposed by your wireless carrier for receiving our messages.

Carrier Liability Disclaimer

Wireless carriers, including but not limited to Rogers, Bell, Telus, Freedom Mobile, AT&T, T-Mobile, and Verizon, are not liable for delayed or undelivered SMS messages sent through the Condo1 Property Management Inc. messaging program. Delivery of SMS messages is subject to effective transmission by your wireless carrier and is not guaranteed.

Age Restriction

The Condo1 Property Management Inc. SMS messaging program is intended for individuals who are at least 18 years of age. By opting in to receive SMS messages from Condo1 Property Management Inc., you represent and warrant that you are 18 years of age or older. If you are under 18, do not submit your phone number or opt in to receive SMS messages.

Opt-Out

You can opt out of SMS at any time by replying STOP to any message from us. Reply HELP for help. You can also withdraw your consent by contacting us at info@condo1.ca.

5. Intellectual Property

All content on the Services — text, graphics, logos, photos, listings, forms, and software — is the property of Condo1 Property Management Inc. or its licensors and is protected by Canadian and international intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not reproduce, modify, distribute, or publicly display any portion of the Services without our prior written consent.

6. Third-Party Services and Links

The Services may link to or integrate with third-party services (for example, our CRM provider LeadConnector / Twilio, Google Analytics, Google Tag Manager, Google Maps, and payment processors). We are not responsible for the content, policies, or practices of third-party services. Review their terms before using them.

7. Property Listings and Information

Rental listings and property information displayed on the Services are provided for general information. We make reasonable efforts to keep listings accurate and current, but we do not guarantee that any listing is available, available at the price shown, or free of errors. Availability, price, and terms are subject to change without notice. Nothing on the Services constitutes an offer to lease or a binding agreement — all tenancies require a signed Ontario Standard Form Lease.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Condo1 disclaims all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Content on the Services is for general information and does not constitute legal, financial, tax, or professional advice. Consult a qualified professional before acting on anything you read here.

9. Limitation of Liability

To the fullest extent permitted by law, Condo1 Property Management Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, or goodwill — arising from or related to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from or related to the Services will not exceed CAD $100 or the amount you paid us for the specific service giving rise to the claim in the twelve months before the claim, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Condo1 Property Management Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your violation of these Terms or your misuse of the Services.

11. Changes to These Terms

We may update these Terms from time to time. The current version is always available at condo1.ca/terms. The effective date at the top of this page tells you when it was last updated. Your continued use of the Services after an update constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms or the Services will be resolved exclusively in the courts of the Province of Ontario sitting in the City of Toronto, and you consent to the personal jurisdiction of those courts.
